This Policy defines the principles for the collection and processing of personal data obtained by the Administrator during account registration in the online store, use of the website, as well as when making purchases without creating an account and when subscribing to the newsletter.

III. Legal basis and purpose of personal data processing

Your personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR).

IV. Your personal data is processed in connection with:

1. the need to perform the contracts you entered into with the Controller, as well as the steps taken prior to entering into the aforementioned contracts at your request (Article 6, paragraph 1, letter b) of the GDPR),

2. the need to comply with the Controller’s legal obligation (Article 6, paragraph 1, letter c) of the GDPR),

3. your consent to the processing of personal data for marketing purposes, including sending commercial information (Article 6, paragraph 1, letter a) of the GDPR),

4. the Controller’s legitimate interest in marketing its own products and services, as well as in securing and pursuing claims (Article 6, paragraph 1, letter f) of the GDPR).

Providing your personal data pursuant to points 1) and 3) above is voluntary; however, refusal to provide your data will prevent you from entering into a contract with the Controller or using the Store and the services provided electronically by the Controller.

The User may at any time withdraw their previously granted consent to the processing of personal data for one or more purposes.

V. Sharing of Personal Data

Your personal data will be shared with competent state authorities or third parties if such an obligation arises from generally applicable law.

The Controller also shares your personal data with a selected carrier or intermediary handling shipments on behalf of the Controller for the purpose of delivery, as well as with entities processing electronic or card payments, financial institutions granting loans for the purchase of goods or leasing, hosting/server service providers and IT entities maintaining an online store, and entities providing legal and debt collection services.

VI. Data Protection

The Controller protects your personal data in accordance with applicable regulations and the highest standards of security and data protection.

The Controller ensures the security of personal data by implementing appropriate technical and organizational measures to prevent unlawful data processing and accidental loss, destruction, or damage. The Controller takes all possible measures to ensure that personal data is:

1. accurate and processed lawfully,

2. obtained only for specific purposes and not further processed in a manner incompatible with those purposes,

3. adequate, relevant, and not excessive,

4. accurate and up-to-date,

5. not retained longer than necessary,

6. processed in accordance with the rights of data subjects, including the right to restrict access,

7. stored securely,

8. not transferred without appropriate protection.

Personal data files are secured against access by third parties. Only persons authorized by the Controller, trained in personal data protection, and obligated to keep your personal data confidential are permitted to process your personal data.

VII. Personal Data Retention Period

Your personal data is processed for the period of:

1. securing or pursuing any claims arising from the contract,

2. post-sales contract management (complaint handling),

3. fulfilling a legal obligation imposed on the Controller (e.g., arising from accounting and tax regulations),

4. objecting to the processing of personal data for marketing purposes based on the Controller’s legitimate interest,

5. withdrawing consent if processing is based on previously granted consent, without affecting the lawfulness of processing based on consent before its withdrawal.

VIII. Rights of the Data Subject

You are entitled to request access to your personal data from the Controller, rectification, erasure, or restriction of processing, to transfer your data, and to object to processing. You may also withdraw your prior consent to the processing of your personal data at any time.

X. Right of access to data, supplementation, update, and deletion

At your request, the Controller will supplement, update, and correct your personal data, as well as suspend (temporarily or permanently) their processing, or delete them if your data proves to be incomplete, outdated, inaccurate, collected in violation of the Act, or is no longer necessary for the purpose for which it was collected.

XI. Right to Object

If the Controller processes your data for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing. To exercise this right, please submit a relevant request to the Controller via email.

XII. Right to File a Complaint

You have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data violates the provisions of the GDPR.

XIII. Changing and Updating Personal Data

If your personal data changes, please update it in your user account, if you have one, or notify the Controller by phone, by letter to the company’s registered office, or by email to the Controller’s email address.

XV. The Administrator’s Use of Cookies

In connection with providing the content of the website, the Administrator uses so-called cookies, i.e., information stored by servers on the user’s end device, which the servers can read each time the device connects. The Administrator may also use other technologies with functions similar or identical to cookies (information regarding cookies also applies to other similar technologies used within our website). Cookies are computer data, specifically text files, stored on the end device of the user of the interneralsgroup.pl website.
